TERMS AND CONDITIONS OF SALE

THESE TERMS AND CONDITIONS OF SALE GOVERN YOUR PURCHASES OF PRODUCTS AND SERVICES FROM VIRTUAL FAMILY KINGDOM ("VFK") ON VIRTUALFAMILYKINGDOM.COM ("SITE") (HOWEVER ACCESSED AND/OR USED, WHETHER VIA PERSONAL COMPUTERS, OR OTHERWISE). EVERY TIME YOU MAKE A PURCHASE ON OUR SITE, YOU ACKNOWLEDGE AND ACCEPT THESE TERMS AND CONDITIONS OF SALE. Every order you place through VFK will be deemed your offer to purchase. We may accept your offer either through an e-mail confirmation or through delivery of the items you requested. Our acceptance of each offer as specified is expressly subject to and conditioned on your acceptance of these (and only these) Terms and Conditions of Sale.

VIRTUAL ITEMS AND SUBSCRIPTION FEES

Purchases of VFK V.I.P. Subscriptions (as defined below) are purchases of a limited, non-transferable, revocable license. The license may be terminated immediately if your account is terminated for any reason, in VFK's sole and absolute discretion, or if VFK discontinues providing the services on the Site.

V.I.P. Subscriptions have no monetary value, are non-refundable and cannot be used to purchase or use products or services other than in-game play offered by VFK (e.g., Virtual Family Kingdom(TM) Furni (defined below).

Virtual Family Kingdom(TM) V.I.P. Subscriptions, your avatar, virtual items (e.g., Virtual Family Kingdom(TM) Furni or credits), are licensed game play activities, they are deemed consumed upon purchase (similar to putting a quarter in an arcade game) and end upon any termination of your account.

COSTS

All prices shown on this Site are subject to change without notice. The prices stated at the beginning of delivery apply. Applicable taxes or shipping and handling charges, which do not apply to virtual products such as digital furniture ("Furni") (if any), are not included in the product prices, but any such charges will be added to your invoice and will be visible before you finish your purchase.

We will collect sales tax in any states we are obligated to do so by law and any applicable sales tax will be added to your purchase.

All Virtual Family Kingdom(TM) V.I.P. Subscriptions and all virtual products (including Furni and all other items or services on the Site) are non-refundable, except, in our sole and absolute discretion or as required by applicable law. Virtual products purchased will be available for use as soon as reasonably practicable.

V.I.P. MEMBERSHIP SUBSCRIPTIONS

V.I.P. Membership subscriptions are automatic monthly delivery of Virtual Family Kingdom(TM) member items, special privileges, and/or Virtual Family Kingdom(TM) Furni on an ongoing basis or during a given period of time ("V.I.P. Subscription"). You agree that by completing the V.I.P. Subscription service registration at the Site, you authorize VFK to charge applicable recurring V.I.P. Subscription fees to your designated billing payment method.

Purchasers of ongoing V.I.P. Membership Subscriptions are billed on a thirty (30)-day cycle, which begins upon membership subscription service registration and ends thirty (30) days thereafter (each a "Subscription Month"). The fee for each Subscription Month is charged on the 1st day of the Subscription Month or within a reasonable time thereafter.

You (together with your legal guardian if you are under eighteen (18) years of age) are solely responsible for setting up payments limits and otherwise configuring the account settings of the billing payment method associated with the V.I.P. Membership Subscription. You represent and warrant to VFK that you are authorized to use the billing payment method (including, without limitation, all accounts, credit cards and such associated therewith) for the purposes of purchasing V.I.P. Membership Subscriptions as described herein.

You can cancel your ongoing V.I.P. Membership Subscription in the following way:

Log in to your Membership Subscription Area and click on the "Unsubscribe” button next to the membership subscription you would like to unsubscribe. You will be asked to confirm your request. Click "Okay” to confirm your unsubscribe request. The end date of your subscription will be filled in and your subscription will not rebill.

If you cancel your V.I.P. membership subscription, your subscription will continue to the end of your subscription period and will not rebill. Cancelled memberships cannot be prorated and, VFK will not refund any remaining portion of your V.I.P. membership subscription Fees. Cancellation will be effected by us within three (3) business days from the receipt of your cancellation request.

CREDIT CARD SECURITY

It is important to us that you feel secure and safe when you shop at Virtual Family Kingdom. Please see our Privacy Policy to understand how we protect your personal information. As part of the shopping process, you may give us your credit card information. We take the responsibility of protecting that information very seriously. We employ industry standard security systems which are compliant with PCI Data Security Standards. Our servers protect your information using encryption and firewall technology throughout the shopping process. We also use state-of-the-art Secure Sockets Layer (SSL) encryption to protect your personal information.

RETURN POLICY

All Virtual Family Kingdom V.I.P. Membership Subscriptions, credits, and all virtual products (including Furni and all other game play, services, activities, or items within the Site) are non-refundable, and non-returnable except in our sole and absolute discretion.

OTHER

We reserve the right to substitute essentially similar materials for items which cannot be obtained in sufficient quantities, or to cancel any excess portion of an order. We shall not be held in default if delivery is delayed, hindered, or rendered impossible by forces of nature, civil commotion, governmental acts, terrorism, war, storm, fire, flood, explosion, walkouts, strikes, other industrial problems, utility, services, network or transportation or interruptions, server crashes, hackers, viruses, technical issues or any other cause beyond our reasonable control. We reserve the right to revise or modify products, product information or pricing without prior notice. We are not responsible for typographical or printing errors.

These Terms and Conditions of Sale will be interpreted and governed pursuant to the laws of the State of Nevada, United States of America, for contracts to be executed and fully performed therein and notwithstanding any principles of conflicts of law. You consent specifically to personal jurisdiction in the State of Nevada in connection with any dispute between you and VFK arising out of these Terms and Conditions of Sale or pertaining to the subject matter hereof. The parties to these Terms and Conditions of Sale each agree that the exclusive venue for any dispute between the parties arising out of these Terms and Conditions of Sale or pertaining to the subject matter thereof will be in the state and federal courts in Nevada. The parties specifically disclaim application of the Convention on Contracts for the International Sale of Goods. YOU IRREVOCABLY WAIVE ALL RIGHTS TO BRING OR PARTICIPATE IN ANY CLASS ACTION SUITS OR CLAIMS REGARDING THE MATTERS RELATED HERETO AND CONSENT TO THE MANDATORY ARBITRATION PROVISIONS IN THE Terms of Use.

If any part of these Terms and Conditions of Sale is void, unlawful or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms and Conditions of Sale constitute the entire agreement among the parties relating to this subject matter. To the extent a purchase order, confirmation letter, or other communication is inconsistent with these Terms and Conditions of Sale, these Terms and Conditions of Sale will govern, unless specifically agreed to in writing otherwise by an executive officer of VFK (i.e., regular employees cannot obligate VFK).
